President Trump’s Administration Seeks Dismissal from Transgender Sports Lawsuit in New Hampshire
CONCORD, N.H. (AP) — The Trump administration has moved to be dismissed from a lawsuit filed by two New Hampshire teens, Parker Tirrell (16) and Iris Turmelle (14), who are challenging the state’s ban on transgender athletes participating in girls’ sports alongside Trump’s executive order on the issue.
In a motion submitted on Friday, the government argued that the teens lack the standing to include the federal government in their case, describing the situation as a "generalized grievance" rather than an imminent injury. Deputy Associate Attorney General Richard Lawson emphasized that the government has not enforced Trump’s executive orders in New Hampshire and may never do so.
Trump’s “Keeping Men Out of Women’s Sports” order grants federal agencies significant power to ensure compliance with Title IX, which prohibits sexual discrimination in education. The administration aligns with a definition of sex based on gender assigned at birth. Conversely, the teens’ legal team contends that the executive order, along with a January 20 directive banning the use of federal funds to "promote gender ideology," subjects transgender individuals to discrimination, violating equal protection rights and Title IX.
The federal government maintains that the order does not discriminate because it views male and female athletes as not similarly situated. Despite transgender youth representing around 1.4% of the teen population in the U.S., over half of the states have implemented similar bans, with supporters arguing it maintains fairness in women’s sports.
Both Tirrell and Turmelle assert they do not feel they have an advantage over their peers, with Turmelle recalling her unsuccessful tryout for the softball team as evidence of her commitment to the sport. The case continues to unfold as the teens challenge both state and federal policies.
