Washington Murder Case Dropped Due to Lost DNA Evidence


In a significant development shortly before a Washington murder trial, prosecutors withdrew charges against Kavon Young, who had been in custody for over five years, citing insufficient evidence. The case revolves around the 2010 shooting death of John Pernell, a retired protective service officer, during a Fourth of July barbecue when he was confronted by a group attempting to rob him and his friends. After years of a stalled investigation, a witness in 2019 pointed authorities to Young, and DNA found under Pernell’s fingernails was initially linked to him, showing a likelihood of one in 3.4 billion of not being Young.

However, just two days before the trial, prosecutors informed Pernell’s family that the DNA analysis was now deemed unreliable due to a calculation error. This abrupt reversal left the family seeking explanations, with Pernell’s daughters expressing their distress at not understanding the shift and feeling like victims themselves. They received a call from prosecutor Michael Spence, who acknowledged the mistake but did not provide details.

Complicating matters further, the private lab that conducted the DNA testing, Bode Technology Group Inc., lost crucial evidence, making retesting impossible. The judge indicated that jurors would be made aware of the negligence involved. Despite the earlier backing of the DNA findings as evidence against Young for years, the lack of clarity around the case has sparked outrage among Pernell’s family, prompting them to reach out to local lawmakers. The Deputy Mayor for Public Safety expressed condolences and stated that the case would be further investigated to ensure justice for Pernell’s family.
