Trial Begins for Consultant Over AI-Generated Robocalls in New Hampshire Primary
CONCORD, N.H. – Steven Kramer, a political consultant, goes on trial today in New Hampshire, accused of voter suppression and impersonating a candidate through AI-generated robocalls mimicking former President Joe Biden. Kramer faces 11 felony and 11 misdemeanor charges, potentially leading to decades in prison if convicted.
Kramer admitted to sending a message to thousands of voters just two days before the state’s first-in-the-nation primary on January 23, 2024. The call featured an artificial intelligence voice that echoed Biden’s phrasing, misleadingly suggesting that cast votes in the primary would negate their ability to participate in the November election. “Your votes make a difference in November, not this Tuesday," the robocall stated.
Kramer, who runs a get-out-the-vote firm, claims he aimed to highlight the dangers posed by AI, arguing, “Maybe I’m a villain today, but I think in the end we get a better country and better democracy because of what I’ve done.” His defense could hinge on the argument that the primary lacked legitimacy, as the Democratic National Committee had rearranged its calendar position. However, the state maintains that the election remained valid.
The trial has attracted significant attention as it addresses not only legal questions about election integrity but also the implications of AI in political campaigns. Judge Elizabeth Leonard decided that the jury would not be required to accept the state’s classification of the primary as valid but acknowledged its relevancy to the case. Kramer’s legal battles are compounded by a $6 million fine from the Federal Communications Commission, which has not yet been resolved.
As states grapple with regulations around AI in elections, House Republicans recently attempted to limit local controls, raising concerns about misuse of technology in political spheres.
