New Hampshire court to address legal issues around transgender athletes


Transgender athletes in New Hampshire are at the center of two federal court cases, with hearings scheduled for Thursday. The first case involves two transgender teen girls challenging a state law banning transgender girls from participating in girls’ sports teams. The teens are seeking to overturn the Fairness in Women’s Sports Act in an effort to protect the rights of all transgender students in the state.

The second case revolves around parents who were barred from wearing pink wristbands with “XX” representing female chromosomes at a girls’ high school soccer game. The parents were supporting one of the transgender girls who was playing on the opposing team. The school district issued no-trespass orders against the parents, which have since expired, leading to a lawsuit claiming their First Amendment rights were violated. The parents are seeking a court order against the school district to continue wearing the wristbands at future school events.

Governor Chris Sununu signed the Fairness in Women’s Sports Act into law, stating it ensures fairness and safety in women’s sports by maintaining integrity and competitive balance. Similar laws are in place in about half of the states across the country. School district officials in Bow, where the second case is taking place, defend their actions in barring the parents from wearing the wristbands, stating they were protecting the transgender girl from intimidation and harassment during the game. The lawsuits highlight the ongoing debate and legal battles surrounding transgender athletes’ rights and inclusion in school sports.
