Transgender teens contest New Hampshire law prohibiting them from joining girls’ sports teams – JURIST

Two families in New Hampshire are taking legal action against high school and state officials in an attempt to block a bill that would require schools to assess students’ eligibility for sports teams based on their biological sex, rather than their gender identity. The families filed a federal lawsuit claiming that the bill violates the Equal Protection Clause of the Fourteenth Amendment and Title IX by discriminating against transgender individuals.

The families argue that there is no rational basis for the bill, as it is based on stereotypes and misconceptions and serves no important state interest. They have requested a temporary restraining order and preliminary injunction to stop the bill from going into effect before soccer practice starts on August 19.

Similar laws in other states have faced legal challenges, with the governors of Ohio and Wisconsin taking action to veto bills that would restrict transgender youth from participating in sports. Despite this, the Ohio legislature overrode the governor’s veto. The US Supreme Court has yet to rule on the legality of laws banning transgender youth from sports, but it recently declined to reinstate Title IX rules that would expand protections for LGBTQ+ students.

The families in New Hampshire are seeking to protect their transgender daughters from discrimination and harm, arguing that denying them the opportunity to participate in sports based on their gender identity is deeply damaging. The outcome of this lawsuit could have far-reaching implications for transgender youth across the country.
